Basic Information about Wrongful Work Termination

Add Your Picture More often than not, employees who are terminated from work feel that the move made by their bosses is illegal, unethical, or even unfair. Given that, a person should recognize the issues surrounding wrongful termination.

Employment law is a legal term used to refer to the legal relationship between the worker and the boss. A violation of the law will often lead to tensions in the workplace, thus lessening the productivity of the employee and may trigger unfavorable treatment coming from the boss.

Oftentimes, companies have their own manuals or handbooks wherein the employee will see the policies and regulations governing actions and proper conducts in the workplace, procedures in case of filing for complaints, rights of employees, steps in resignation, and termination policies.

Reasons for illegal termination

An employee may file a case against his/her boss if that worker sees the presence of wrongful termination or any other related reasons. Once the employer committed a fault in terminating the contract of the employee because of the following reasons, the later has the right to demand and hire the assistance of an employment attorney:

1. Retaliation – Retaliation happens when an employer fired a worker because of the latter s refusal to work in an illegal activity started by the employer, or if the employer reported any unlawful practices in the office.

2. Discrimination – If an employee was fired because of his/her gender, religion, race, disability, and beliefs, the employer committed an illegal termination.

3. Breach of Contract – When you are hired by the company whether as a probationary employee or a regular one, a contract will be drawn between you and the big boss. If you are terminated from work, go over your contract and see if there is a violation made by the company.

4. Character Defamation – Calling an employee names to defame him/her is already a good and sound basis for filing a case against the employer.

Aside from these things, there are also other grounds wherein an employee s rights are violated. If you feel that you are terminated, do not hesitate to talk to an attorney. The employment law is there to protect the welfare of the employees. If you want to make sure that you are protected from employers who take advantage of employees who are not aware of the employment law.
