If such things need to be avoided, the opposite party can decide to settle the losses outside the court and you can walk away with the compensation, without even fighting a case. Another advantage of this kind of out of court settlement for the losing side is that a lot of time is saved, along with costs of hiring a lawyer, the paperwork and legal work that will follow. All this usually has to be paid by the losing side, so avoiding it is always a better option if the chances of winning aren't great. Most importantly losing a case will be a permanent record tarnished and very few would actually want that.

Taking the help hiring a good lawyer is very important in such a scenario. You don't want to end up in a bigger mess of paying your opponent's charges, if you lose the case. Hence you need to consider your situation and the chances of your winning before you go to court claiming total compensation for your losses.
