As with any lawyer, practicing litigation attorney is one who has graduated from law school and been accepted to the bar association in the state of his practice.

The term "litigation" is used sometimes to distinguish lawsuits from alternate dispute resolution methods such as arbitration in which a private arbitrator would make the decision, or mediation” which is a type of structured meeting with the parties and an independent third party who works to help them fashion an agreement among themselves.

It is a fancy legal term for the practice of carrying a lawsuit through the court process while some attorneys prefer to handle settlements and some lawyers practice criminal law. For the most part they focus exclusively on lawsuits, and after all, lawsuits are what litigation is all about.

The different kinds of legal cases where litigation is practiced are practically unlimited while one litigation attorney might focus on one specialty or niche type of litigation, others will practice more generalized litigation, covering all kinds of lawsuits.

Because major personal or toxic injury cases, such as those involving benzene exposure or other workplace hazards, are so incredibly complex, an attorney or even a team of litigation attorneys usually cover such large lawsuits. A general practice attorney, like the one you might turn to in order to update a will or fight a traffic ticket, just doesn't have any kind of experience or level of specialization needed when it comes to major lawsuits like an expert will. Practicing law is not a one size that fits all endeavor, there are simply different attorneys for different situations.

Litigation process takes quite long time because the countless number of details and legal procedures that have to be followed here. It looks simple, but quite complicated process. They draft a variety of pleadings and motions on the behalf of plaintiff or defendant. Plaintiff attorneys draft a variety of motions including motions to strike, dismiss, amend or change venue and motions for judgment on the pleadings.

Most cases never reach trial but instead they are settled in order to eliminate the risk and trial expansion. The attorneys may settle a case any time during the litigation life cycle. On settlement, litigators engage in negotiations with opposing parties that participate in mediation and settlement conferences with judge or parties and create settlement brochures, agreement, and other settlement materials.
