All you need to know about Conveyancing

Article Written By: TomBaker

Add Your Picture Conveyancing is the legal process of transferring ownership of property from one person to another. It includes the whole process of putting a property on the market, creating and concluding an agreement to sell and buy, and then the actual transfer of ownership from the vendor to the purchaser.

There are three options – engage a lawyer/solicitor to attend your legal work as well as conveyancing work; have a licensed conveyancer represent you; or use a do it yourself conveyancing kit. The latter option can be quite risky because consumers do not have access to the same insurance available to a qualified lawyer/solicitor. So, if a mistake is made, the consumer remains personally responsible with nowhere to go for financial compensation.

Hiring a licensed conveyancer is quite risky as well, as they do not have legal skills. They are permitted to perform a very limited range of legal work associated with conveyancing transactions, but are not permitted to give advice on important issues related to the transaction. Licensed conveyances also do not have access to the same legal resources as lawyers, and cannot brief a barrister for specific advice in circumstances where court action may be necessary.

Engaging a conveyancing lawyer or solicitor is the safest way to complete a conveyancing matter. Not only can the lawyer complete the minimal conveyancing work, they actually have a duty to advise clients and share their knowledge, skill and expertise. Other related areas such as Family Law, Taxation, Wills and Estate, just to name a few can affect or be affected by conveyancing – and lawyers will be able to provide advice on these issues.

You will require the services of a conveyancing solicitor if you are thinking about moving house and want legal advice concerning buying, selling, renting or leasing a property. Finding the right solicitor is quite difficult, as there are many choices out there. First and foremost, you should find a conveyancing solicitor that has experience in the type of purchase that you are dealing with.

Ask your friends and family who have moved houses recently, for recommendations if any. Find out more about the entire process by reading up on the issue on the internet. You can find many solicitors online, and read about the services they provide and so on. It is always wise to find testimonials for your conveyancing solicitor before hiring them so you have an idea of how people respond to their work.
