Individuals who usually use this are relatives that would like to entrust their properties to another relative. People with real estate sometimes includes this when they want to sell or buy something.

The person that will be the one to either sell or transfer his property is referred to as the grantor. The one that will buy it from him or the one to whom the property will be transferred is known as the grantee.

For it to be come legal, it needs to have the signature of the grantor in it together with the grantee and the witnesses. A witness is only applicable if it is required to have one in a certain state. There is also a need to put the specific location of the property and the sum the grantee used to purchase it. The next step is to have it notarized.

This is commonly used by two people who are going through a divorce. A divorce would need the two parties to make an agreement as to how to divide the properties that they have accumulated during their marriage. An example of this is when the husband would transfer the deed of the house to his wife so that she will gain sole ownership of it after the divorce.

A relative can also use this if there are certain properties that he would like another relative or a close friend to have. This is a good way of preventing conflicts between family members that sometimes happen when it comes to dividing the properties that were left behind by a deceased relative.

In situations like the one above, a person can still inhabit the house whose deed he has already transferred to someone else. This is what happens if the grantor used a life estate agreement. Life estate would mean that the grantor can still use the property until the day of his passing.

Aside from family member, people who are into real estate can also make use of this. The downside when using this is that it does not protect the person who will purchase the property in case there is someone who will claim that they are the one who owns it. To prevent this from happening, a title search is necessary.

It is very hard to reverse the document once it has been made legal that is why you need to be very sure with your decision. If you want to reverse it, you have to let the grantee freely give up his rights or you have to prove that the transaction was not done in a valid way.

When dealing with a Quit claim deed, you have to be very certain with what you will do. Both parties must know the risks that are involved in it. It is a good idea that one would hire an attorney to make sure that there will be no problems that will be encountered by the person who will wish to avail of it.
